Court sides with campaigners over ‘unlawful’ Heathrow expansion

The Court of Appeal has ruled that the Airports National Policy Statement (ANPS) was unlawful because it failed to take into account the government’s commitment to provisions in the Paris agreement on climate change – ratified by the UK in November 2016.

The ANPS sets the planning policy framework Heathrow Airport will use to bring forth a planning application for its third runway.Judges Lord Justice Lindblom, Lord Justice Singh and Lord Justice Haddon-Cave concluded that “the ANPS was not produced as the law requires, and indeed as Parliament has expressly provided”.They said the statutory regime for formulating a national policy statement,........
