Brexit instruments for environmental assessments unveiled

The government has published statutory instruments for environmental assessments and the planning system after Brexit.

The Ministry of Housing, Communities and Local Government said the instruments make no substantive changes of policy and aim to “ensure the continued smooth operation” of environmental impact assessments, strategic environmental assessments and hazardous substances regulations.

The instruments make a small number of amendments to other planning legislation where there are references to obligations in EU law that are redundant or no longer appropriate.

The amendments aim to ensure that these regimes will continue to operate as they did before the date the UK leaves the EU and will not be retrospective, avoiding any need to re-examine any decisions made before Brexit.
